2. Description of Service

EverestX is a managed hiring platform that sources, vets, and places digital marketing professionals with agencies. Our services include talent vetting, AI-powered video interviews, skill assessments, and managed placement through our Employee Seats model.

3. User Accounts

Registration

To use certain features of the Platform, you must register for an account. EverestX operates on an invite-only basis for talent, and enterprise registration for companies.

Account Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Providing accurate and complete information
  • Notifying us immediately of any unauthorized use

4. Talent Users

As a talent user, you agree to:

  • Provide accurate information about your skills, experience, and qualifications
  • Complete assessments honestly without cheating or using unauthorized assistance
  • Participate in video interviews professionally and authentically
  • Respond to job opportunities and communications in a timely manner
  • Maintain professional conduct in all interactions

5. Client Users

As a client, you agree to:

  • Provide accurate job descriptions and requirements
  • Treat all candidates with respect and professionalism
  • Use candidate information only for legitimate hiring purposes
  • Pay all fees and charges as agreed
  • Comply with all applicable employment laws

6. Prohibited Conduct

You may not:

  • Provide false or misleading information
  • Impersonate any person or entity
  • Harass, abuse, or harm other users
  • Use the Platform for any illegal purpose
  • Attempt to circumvent security measures
  • Scrape or collect data without authorization
  • Interfere with the proper functioning of the Platform
  • Share account credentials with others

7. Intellectual Property

The Platform and its contents, features, and functionality are owned by EverestX and are protected by copyright, trademark, and other intellectual property laws.

You retain ownership of content you submit but grant EverestX a license to use, display, and distribute such content in connection with our services.

8. Fees and Payment

Certain services may require payment. All fees are non-refundable unless otherwise specified. We reserve the right to change our fees at any time with reasonable notice.

9. Disclaimer of Warranties

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT YOU WILL FIND EMPLOYMENT OR SUITABLE CANDIDATES THROUGH OUR PLATFORM.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVERESTX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM.

11. Termination

We may terminate or suspend your account at any time for any reason, including violation of these Terms. You may also terminate your account at any time by contacting us.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms and updating the effective date.
